These terms govern your access to and use of the public myDevPartners website.

Important distinction

Using this website or submitting an inquiry does not create a consulting, development, fiduciary, medical, legal, or other professional relationship.

Client work begins only under a separate written agreement signed by the applicable parties.

1. Acceptance of these terms

These Terms & Conditions (“Terms”) govern your access to and use of www.mydevpartners.com and its public marketing pages (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. About the Site

The Site provides general information about myDevPartners, Fractional Chief AI Officer leadership, AI transformation, governance, cloud and software delivery, healthcare-focused capabilities, and related solutions. Site content may be changed, corrected, updated, suspended, or removed at any time.

3. No client or professional relationship

Site content and communications through the general inquiry form are for informational and business-development purposes only. They do not create a client, advisory, consulting, fiduciary, employment, partnership, medical, legal, compliance, or other professional relationship.

Any consulting, software development, AI, healthcare, data, cloud, or other services will be governed by a separate written agreement, statement of work, business associate agreement, data-processing agreement, or other applicable contract. If those agreements conflict with these Terms, the signed agreement controls for the services it covers.

4. No medical, legal, or compliance advice

Nothing on the Site is medical advice, a clinical recommendation, legal advice, regulatory advice, or a guarantee of compliance, safety, performance, or business results. Healthcare and responsible-AI content describes capabilities and possible approaches. Qualified clinical, legal, privacy, security, and compliance professionals should evaluate each organization’s specific requirements.

5. Inquiry forms and communications

You agree that information you submit is accurate, lawful, and that you have authority to provide it. Do not submit patient records, protected health information, medical records, Social Security numbers, payment-card data, passwords, authentication credentials, trade secrets, or other regulated or highly sensitive information through the public inquiry form.

Submitting an inquiry authorizes us to respond using the contact details you provide. It does not create an obligation for either party to enter an engagement and does not create a nondisclosure agreement.

6. Permitted use

You may use the Site for lawful informational and business purposes. You may not:

  • Violate any applicable law or the rights of another person or organization.
  • Attempt to gain unauthorized access to the Site, systems, accounts, or data.
  • Probe, scan, disrupt, overload, scrape, or interfere with Site security or operation.
  • Introduce malware, harmful code, deceptive content, or automated abusive traffic.
  • Misrepresent your identity, affiliation, authority, or the source of information.
  • Copy, republish, or exploit Site content except as allowed by law or written permission.

7. Intellectual property

The Site and its text, design, graphics, branding, code, demonstrations, and other content are owned by myDevPartners or used with permission and are protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, nonexclusive right to access the Site for its intended purpose. No other license is granted.

Third-party names, logos, and product references belong to their respective owners. Their appearance does not imply endorsement unless expressly stated.

8. Third-party services and links

The Site may link to third-party websites, products, platforms, or demonstrations. We do not control and are not responsible for their availability, content, security, accuracy, or privacy practices. Your use of a third-party service is governed by its own terms and policies.

9. Privacy

Our Privacy Policy explains how we handle information collected through the Site and is incorporated into these Terms by reference.

10. Disclaimers

To the maximum extent permitted by law, the Site is provided “as is” and “as available.” We make no warranties, express or implied, regarding availability, accuracy, completeness, reliability, fitness for a particular purpose, merchantability, non-infringement, security, or error-free operation. Site examples, case descriptions, solution concepts, and outcome statements are illustrative and do not guarantee results.

11. Limitation of liability

To the maximum extent permitted by law, myDevPartners and its owners, personnel, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Site.

To the maximum extent permitted by law, total liability arising from Site use will not exceed the greater of one hundred U.S. dollars or the amount you paid specifically to access the Site during the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless myDevPartners and its owners, personnel, contractors, and affiliates from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of the Site, information you submit, or your violation of these Terms or another person’s rights.

13. Suspension and termination

We may restrict or terminate access to the Site when reasonably necessary to protect the Site, enforce these Terms, comply with law, or address security or abuse concerns. Provisions intended by their nature to survive termination will remain effective.

14. Governing terms for disputes

If you have a signed services agreement with myDevPartners, the governing-law and dispute provisions in that agreement control disputes relating to those services. For Site-only disputes not covered by another agreement, applicable law and jurisdictional rules will govern. Before filing a formal claim, the parties should attempt in good faith to resolve the issue through written notice and reasonable discussion.

15. Changes to these Terms

We may update these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated. The date at the top identifies the latest revision. Continued use of the Site after an update constitutes acceptance of the revised Terms.
